General Product Safety Directive (GPSD):

Directive 2001/95/EC

The aim of the GPSD is to ensure only safe products are placed on the market. The important note here is:

The GPSD applies in the absence of any other EU legislation, national standards, Commission recommendations or code of practices relating to the safety of products.

As well as complementing sector specific legislation, specific rules exist for toys, electrical and electronic goods, cosmetics, chemicals and other specific product groups. Pharmaceuticals, medical devices and food are not covered by the GPSD and fall under separate legislation.

The obligations of the GPSD sit with both businesses and Member State authorities. Business are required by law to inform consumers of any risks associated with the products the supply. There is also an obligation of traceability so any products that present dangers can be removed and traced back to the owners.
